WorldAir RESERVES THE RIGHT (SUBJECT TO APPLICABLE LOCAL LAW), IN ITS SOLE DISCRETION, TO MONITOR YOUR ACCOUNT, INCLUDING BUT NOT LIMITED TO THE USE OF A USER'S MAIN ACCOUNT AND ANY SUB-ACCOUNTS, FOR THE PURPOSE OF INVESTIGATING VIOLATIONS OF THIS AGREEMENT OR TO ASSIST WITH CRIMINAL OR CIVIL INVESTIGATIONS.
WorldAir may also disclose aggregate, anonymous data based on information collected from users to investors and potential partners. In such cases, only statistical information will be disclosed and personally identifiable data will be kept confidential. In case WorldAir is sold, the information collected from users may be transferred to the new owners.
Our customers and users will occasionally receive newsletters or e-mails with information on products, services, or special offers. Out of respect for the privacy of our users, WorldAir gives them the opportunity to opt-out from receiving these types of communications.
On rare occasions, it is necessary to send out a strictly service-related announcement, if, for instance, our service is temporarily suspended for maintenance. You are responsible for the security of your Customer ID and passwords. Make sure you keep them in a safe place and do not share them with others. The client expressly understand and agree that World Air shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if WorldAir has been advised of the possibility of such damages), resulting from: 1. the use or the inability to use the WorldAir API; 2. the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the WorldAir service; 3. statements or conduct of any third party on the World Air API (unless such third parties are World Air’s subcontractors); or 4. any other matter relating to the World Air API service.
World Air warrants that it has and will maintain all necessary licences, consents, and permissions necessary for the performance of its obligations under this Agreement.
World Air warrants and undertakes that it will employ best efforts to guarantee that the interfacing of World Air API with the Client’s systems will not cause viruses, or other malicious or technologically harmful materials to be introduced into The Client’s systems.
Any decisions or claims The Client makes based on data from the World Air API are The Client’s sole responsibility. WorldAir shall not be held liable for any such decisions or claims.
World Air 's total liability to The Client for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence), or otherwise) shall not exceed the amount paid by The Client, if any, for accessing the World Air API. The Client’s total liability to World Air for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence), or otherwise) shall not exceed the amount paid by The Client.
World Air will provide a limited email support to The Client. The response for all technical and other inquiries will in general be provided within two business days. However, World Air doesn’t guarantee that all emails will be responded within two business days.
